Terms and Conditions
Please read this page carefully.
This page contains the generic terms of business by which Circus Creative Ltd works. This page
also states the Terms and Conditions under which you, the Web site visitor (hereinafter "You" or "visitor")
may use this site, the content of which is owned by or licensed to the Circus Creative Web site
and is operated and administered by Circus Creative.
Terms of Business unless otherwise negotiated
All copyright or other intellectual property rights in any materials created or devised by Circus Creative
remain our property until receipt of all payments due for work are received. Upon receipt of the
final payments (unless otherwise stated) all copyright and other intellectual rights will pass to the Client.
This excluded any code or system elements that are copyrighted by Circus Creative. However
Client agrees to waive all rights to resale unless written permission is received from Circus Creative.
Circus Creative retains all moral rights to all such copyright notices, and unless stated in writing
the client will allow Circus Creative to demonstrate such copyright work on our portfolio and to
other prospective clients. For all web works the Client agrees to allow Circus Creative to display a
small logo and link to our portfolio site unless otherwise stated in writing. Circus Creative reserves
the right to charge a fee to remove said logo from client's works.
Payment Terms are unless otherwise negotiated
Invoices will be made in 2 parts - 50% on sign-off as a deposit and 50% on completion unless otherwise
negotiated. Circus Creative reserves the right to delay any agreed start dates of projects until the
deposit is received. All invoices are to be paid by the agreed date. Invoices that are overdue by 30 days
will incur interest according to EU legislation 2000/35/EU whereby interest will be added to the invoice
from the date due at the rate of 7% above CEB rates for European work, and 8% above Bank of England
interest rate for all invoices in the UK. Interest charges are Circus Creative's discretion and Circus
Creative may chose to waive the charges on a project-by-project basis.
All expenses that occur in relation to project development such as travel, accommodation, printing, legal
fees etc will be billed in addition to project. Circus Creative promises to keep these to a minimum
and to inform the Client before hand.
If Circus Creative supplies any deliverable relating to a project, it will be deemed accepted if the
Client does not communicate back within 10 working days. Any deliverable that is taken and used in a live
environment will be automatically considered accepted and any further changes deemed as a change
request.
The Client is responsible for coordinating any third party companies; systems or supplies and Circus
Creative will not be held liable for any negligence caused by 3rd parties. Any delays incurred due
to 3rd party delays or non-participation may result in increased deliver times and costs.
If the scope of project changes from the specifications outlined in the project plan or Circus Creative
is required to provide additional services not described in the agreed project plan, such changes
will be documented in a change request and may impact timings and costs. Client must agree to such
changes and sign-off before any additional amendments will be undertaken.
The Client will ensure that all necessary permissions for the use of any source material have been
obtained and that the materials contain no defamatory matter and are free of all other legal restrictions and
you will indemnify us against any costs and losses incurred by us, our employees or agents in the event of
a third party claim against us, or any of the above persons.
Typical projects that Circus Creative undertake relies on the close cooperation and involvement of
the Client's internal staff and team to provide input, review and approve deliverables and to be available
for meetings, presentations and conference calls throughout the project life-cycle. The Client will be
responsible for ensuring all the Client's internal staff and team members, as well as stakeholders, are fully
involved in collating feedback. If resources booked are not used due to late feedback from the Client, this
cost will be added to the project spend and may result in an increase to the agreed cost.
Circus Creative will not undertake projects of the following nature:
a) Pornographic or offensive websites / materials
b) Scam websites, pyramid schemes or spam
c) Online sales of illegal goods
If the Client tries to hide their intentions from Circus Creative, only to be discovered at a later date
during the development cycle, the Client's project will be cancelled immediately and all monies paid
deemed non-refundable.

By using this site, you agree to be bound by all of the Terms and Conditions set forth below. If you do not
accept these Terms and Conditions, please do not use this site. Circus Creative reserves the right
to update or amend these terms so we recommend you check these periodically.
Circus Creative makes no representations, warranties, or assurances as to the availability, accuracy,
currency, or completeness of this site or its contents. Circus Creative site shall not be liable
for any damages or injury resulting from Your access to, inability to access, or use of this site, including,
without limitation, any damages or injury arising from any links to other sites contained within or referred to
in this site.
Contact Us Page
The Contact Us page is the primary means of communication with interest in any of Circus Creative.
Web site visitors may use the Contact Us page to send content suggestions or questions about
any content contained on any Circus Creative sites. Web site visitors may also use this information
to ask general questions about the Web site or content, submit notification of broken links, communicate
privacy concerns, and/or submit praise and/or complaints. All comments are seen by the Directors of
all Circus Creative offices that handle all content-related issues and will use these comments, for instance, as
ideas for generating new content. All information placed on the contact us form is given freely and voluntarily
and will be bound by our privacy policy.
User Submissions
Circus Creative welcomes your comments on its site and Content. However, You acknowledge
that if You send us creative suggestions, ideas, notes, drawings, concepts, inventions or other information,
(collectively, the "Information"), the Information shall be deemed, and shall remain, the property of Circus
Creative. By submission of any Information to us, You assign to us and we shall exclusively own
all now known or hereafter existing rights to such Information and shall be entitled to unrestricted use of
the Information for any purpose whatsoever, commercial or otherwise, without compensation to You.
As a user of this site, you are responsible for your own communications and are responsible for the consequences
of their posting. Therefore, do not do any of the following things: transmit to us material that is
copyrighted, unless You are the copyright owner or have the permission of the copyright owner to post it;
send material that reveals trade secrets, unless You own them or have the permission of the owner; send
material that infringes on any other intellectual property rights of others or on the privacy or publicity rights
of others; send material that is obscene, defamatory, threatening, harassing, abusive, hateful, or embarrassing
to another user or any other person or entity; send sexually explicit images; send advertisements
or solicitations of business; send chain letters or pyramid schemes; or impersonate another person.
Circus Creative reserves the right to expel users and prevent their further access to this site for
violating these terms or the law and reserves the right to remove any communications from this site. The
violation of any of the terms and conditions set forth on this Terms and Conditions page shall result in the
immediate revocation of Your right to use the Content and obligates You to immediately destroy any copies
of the Content in Your possession.
